Eliminate or Restructure Your Debt

Let’s face it. Your finances can’t always be in the best shape. Bankruptcy, while a scary concept, can provide you with relief from your creditors and get you a fresh start.

My law firm helps individuals and businesses eliminate or restructure their debt. The process can take as little as three months.

If you are struggling with a mountain of debt, bank levies, garnishments, or even lawsuits, bankruptcy might be the right solution for you. Don't delay any longer. Call my office at (916) 333-2222 to schedule a bankruptcy consultation.

Chapter 7 Bankruptcy

Chapter 7 is what most people think of when they hear the word "bankruptcy." Chapter 7 provides you with a "fresh start." The goal of Chapter 7 is to eliminate debt — for this reason, it is the most popular bankruptcy in America.

Chapter 7 bankruptcy takes about three to four months. You are allowed to keep a certain amount of property (generally more than you think), and the Bankruptcy Trustee uses any non-exempt property to pay your debtors. At the end of the proceedings, you will emerge debt free (a few exceptions apply) and ready to start over.

Chapter 13 Bankruptcy

Chapter 13 is sometimes called a "reorganization." Chapter 13 bankruptcy will last anywhere between 3 and 5 years. During that time, you will be on a repayment plan and will be required to repay a percentage of your unsecured debt. You will also have to provide for your secured debt as well.

At the end of your Chapter 13 plan, any remaining unsecured debt will be extinguished. Chapter 13 bankruptcy can help you reorganize your finances on YOUR terms. It is a very popular option for repaying tax debts or saving a home from foreclosure.
